A sick leave is paid absence from work. An employee is entitled to use sick leave for personal medical needs (medical appointments, dental visits, absent due to illness or injury) and/or for care of a family member. In general, Labor law of Republic of Serbia and related legislative and corporate guidelines stipulate that sick leave abuse may result in disciplinary action including termination of employment. However, before termination, the employer must prove that the employee was in fact abusing the sick leave.

PROTECTA MCI undertakes all the necessary actions in accordance with professional standards and applicable laws to identify and document individuals and actions that may be used as an evidence against persons that are abusing sick leave providing an employer with indisputable facts and legal evidence in disciplinary actions and/or the process of termination of employment.

We document employee’s activities inconsistent with recommendation of health care professional, and/or activities indicating that an employee is abusing sick leave while working for another employer, and/or an employee who has left place of residence while on sick leave.

PROTECTA MCI specializes in identifying violations of Article 179 of Labor Law, and violations of Article 85 of Health Insurance Law documenting evidence of sick leave abuse sufficient to support a finding that an employee in fact has abused sick leave and therefore, is about to undergo disciplinary and/or dismissal procedure.
